L-1 Visas For Intracompany Transferees

In order to obtain an L-1 visa for an intracompany transfer, you must meet the following requirements, among others:
- Your U.S. business must be clearly affiliated with the foreign-based business entity in which the employee currently works. The foreign-based business can be a branch of your company, a subsidiary, a parent company or another related entity. To prove the relationship, you may produce articles of incorporation, annual reports or other documents that show the businesses’ common ownership.
- The employee must have worked a certain amount of time in a qualifying role. The employee must have worked abroad for at least one year out of the last three. He or she must also have served as an executive, a manager or an employee with specialized knowledge, and the position you are offering in the U.S. must be comparable.
- You must obtain physical office space in the U.S. The amount of space you purchase or lease will depend on your business needs.
If the L-1 visa is granted, the employee will be able to live and work in the U.S. for up to three years. Extensions are possible in many cases.
