Your company may be able to bring a Canadian or Mexican employee to the U.S. with a TN visa if the following apply:
- The position your company is offering requires a full-time or part-time NAFTA professional.
- The employee’s profession is included on the list maintained by NAFTA.
- The employee has the appropriate level of education and experience.
- The employee is an actual citizen of Canada or Mexico, not a permanent resident.
Note: In many cases, Canadian citizens can apply for TN nonimmigrant status when they reach a port-of-entry in the U.S. A TN visa may not be necessary. However, Mexican citizens are always required to obtain TN visas prior to entering the country.
Ensuring Your Employee Is Prepared For The Interview
In most cases, your prospective employee must attend an in-person interview at a U.S. Embassy or Consulate. To ensure that the interview proceeds as smoothly as possible, he or she should bring the following:
- A valid passport
- A copy of the appropriate visa application
- The visa application fee or receipt of payment
- An employment offer or contract from your company
- A recent passport photo
- Documentation of his or her education and experience
